Service Agreement
Content Responsibilities
ArisHost is not held responsible for the content of any sites and related pages hosted under its services.
ArisHost does not review pages for content before they are posted, and does not verify, endorse, or
otherwise take responsibility for the contents of any user-created pages. However, we reserve the right to
remove any page from our servers that we determine is in violation of our rules and guidelines. ArisHost
subscribers are solely responsible for all files contained in their own directory, and can be held legally
liable for the contents of their web site.
Unacceptable Contents
The following is a list of contents, behaviors, and links that are considered UNACCEPTABLE to ArisHost.com,
and are subject to prosecution to the fullest extent of the law:
- Sites that contain, promote, or are linked to topics such as nudity, pornography, adult content, sex, or foul language.
- Exploitation of images of children under 18 years of age.
- Sites that contain, promote, or are linked to cracks, hacks, or other piracy-related sites.
- Sites that have been promoted through spamming or mail fraud schemes, or pages promoting the sending of unsolicited email. Unacceptable usage of ArisHost's resources, including email addresses for spam.
- Any infringement of copyright, trademark, patent, trade secret, or other intellectual property rights.
- Content promoting racism, or any content otherwise considered extremely offensive to others, including that which aggravates, harasses, threatens, defames, or abuses others.
- Information or other material that contains a virus, corrupted data, or any other harmful or damaging component.
- Any act, promotion or incitement of, or instruction for, the commission of illegal activities.
- Storage of log files or non-html content, or any use of space that circumvents the display of advertising.
- Binary files, downloads, etc. that are not linked to an html page on the subscriber site. Links back to files on a subscriber page from other sites must also link first to an html page on ArisHost, which then links to the binary files.
Account Warranty
ArisHost provides free web space for hosting but makes no implied or express warranties about the reliability of this space or related services. We are not responsible for any deletion, alteration, or loss of data due to network or system outages, file corruption, accidental deletion, or any other reasons. We make no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such.
- Subscribers are responsible for regularly monitoring and creating backups of their own files, and agree to use ArisHost's resources and infrastructure at their own risk. This service is provided on an "as is" basis without warranties of any kind, either expressed or implied. Neither ArisHost nor its partners make any warranty with respect to any content, information, services, or products provided through, or in conjunction with, this free service.
- ArisHost and its partners make no guarantee as to the accuracy, correctness, or completeness of any information on these web pages, and are not responsible for any errors or omissions arising from the use of such information; any failures, delays, or interruptions in the delivery of any content or services contained on our servers; or losses or damages arising from the use of the content or services provided by this service provider.
- ArisHost may also link to or include on its web site, resources and information provided by 3rd party partners and registrars. We do not guarantee the reliability of this information, nor does the inclusion of this information imply our recommendation of these services; it is merely provided to assist you in the creation of your web site and provide added value to our service.
- You agree to indemnify ArisHost and its partners against any and all claims and expenses, including attorneys' fees, arising from the use of our services. This expressly includes your responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and any libelous or unlawful material contained within your web site.
Registrar Transfer
Subscribers agree that it can transfer one or more domain name registrations, in accordance with ICANN or registry policy, from or to ArisHost.com. Subscribers also acknowledge and agree that express authorization from someone with apparent authority to legally bind the domain name holder is required before such a transfer can occur.
It is agreed upon that subscribers cannot transfer their ArisHost-registered domain names until sixty (60) days have elapsed from the date of the initial domain name registration. Subscribers agree that the transfer of domain name registrations may be refused if there is a dispute concerning the domain name or the domain name holder's identity.
Registration Information Ownership
Every subscriber acknowledges and agrees that ArisHost owns all database, compilation, collective and similar rights, title and interests worldwide in our domain name and other proprietary information databases, and all information and derivative works generated from those databases.
Domain Name Licensing
Subscribers who license the use of any domain name registered through a third party agree to remain as the primary domain name record holder. Subscribers remain responsible for:
- Providing your own full contact information.
- Providing and updating accurate technical and administrative contact information adequate to facilitate timely resolution of any problems that arise in connection with your domain name and domain name registration.
- All other obligations under this Agreement, including but not limited to, payment obligations.
- As further required by ICANN, you shall accept liability for harm caused by wrongful use of the domain name, unless you promptly disclose the identity of the licensee to a party providing you with reasonable evidence of actionable harm.
Registration Information Management
Changing of domain name registration information may be allowed any time for both newly registered and transferred domain names. Subscribers must use their registered usernames and passwords to access their domain name registration information and it is the rightful duty of each subscriber to safeguard their usernames and passwords from any unauthorized use. In no event will ArisHost be liable for the unauthorized use or misuse of usernames and/or passwords of subscribers.
Policy on Refunds
ArisHost reserves the right to remove and/or delete ANY subscriber site which violates
our general suitable content rules or Acceptable Use Policy
without prior notice EVEN if the subscriber has active paid services. This applies both for
hosting communities and hosted sites.
If ArisHost is forced to terminate services for a specific account, it will NOT return money
prepaid for the current month of service. ONLY advance payments made starting from the subsequent
month will be returned within 20 business days. ArisHost also reserves the right to withold
activation fees for billing module services.
ArisHost specifically will NOT refund payments received for domain registrations and/or transfers
if the procedure for the said registration and/or transfer has already been completed.
There are additional charges for wrong charge backs and bounced checks:

Bounced Charge Fee -- For all accounts in the event of a chargeback, Arishost will immediately suspend the account upon notification of the credit card company and an investigation will immediately occur. If the chargeback is deemed to be erroneous the user agrees to pay Arishost a fee of $35 for processing to reinstate the account. The $35 reinstatement charge should be paid in check payable to Arishost drawable in any US bank.

Bounced Check -- An additional $35 service fee on top of the amount to be paid.
Termination, Suspension, Transfer, or Modification
ArisHost subscribers agree that we may cancel, suspend, transfer, or modify domain name registration services in order to:
- Correct mistakes made by us or the registry in registering your chosen domain name.
- To resolve a dispute under our Dispute Policy.
- To abide by any ICANN or registry adopted policy.
- Prevent high volume, automated, electronic, or repetitive queries, except as reasonably necessary to register TLD names or modify existing registrations. If your registration is cancelled as a result of ArisHost.com correcting a mistake made by us in registering your chosen domain name, we will refund, in whole, any fees paid by you to ArisHost.com or its partners.
It is also best to note that ArisHost holds all rights to terminate, suspend, transfer, or otherwise modify a domain name registration pursuant to a properly authenticated order from a court of competent jurisdiction, or arbitration award, requiring the suspension, cancellation, transfer, or modification of the domain name registration.
It is ArisHost's duty to terminate or suspend any subscriber's account or accounts without prior notice for misconduct and for violation of any of the given guidelines, or for any other reason, and may terminate and delete any and all subscriber information for conduct that we believe is harmful to ArisHost, any of its subscribers, or its partners. Pages found in violation of these items are subject to immediate deletion and removal from our servers.
Amendments
ArisHost subscribers agree to be bound by any amendments that are set out, from time to time, anywhere on the site www.arishost.com.
Domain Renewal
All domain renewal intentions will be verified within 2 days. There is a client responsibility to keep track of their domain records especially expiration dates. Clients are advised to call in, email or fax intentions for domain renewal 1 month before domain expiration. A confirmation email will be sent back the client after. Without such notification, domain renewal will be assumed and the client's credit card is automatically charged.
All charges for domain renewal despite cancellation if intent to cancel is expressed after billing date is non-refundable
Domain Transfer is dependent on the previous registrar's and the domain's account status. Customers requesting for domain transfer will be charged after the request has been made. An automatic update on the domain transfer status will be released for the customer to coordinate with his registrar if there are issues or concerns that need to be settled.

Failure to send a refund request will be taken as acknowledgement of the charges. No further billing adjustments will be acknowledged.
Cancellations
Cancellations for domain renewal should be done at least 2 months before the expiration date. The only way to effectively cancel the account is by downloading and filling up the cancellation form found at http://www.arishost.com/cancel/arishost-cancel.pdf. This should be faxed to
800-989-0809.
Cancellation for add on services should be done by emailing billing@arishost.com. Cancellation requests via phone or chat shall not be honored.
A customer correspondence email or call from Arishost will be received within 72 hrs. This signifies receipt of intent to cancel. Non-receipt of this customer correspondence email or call requires the client to follow up his cancellation request.
